July 23 Internet Sales Tax Update

As I have been doing since May of 2008, here are the latest Internet sales tax updates. These succinct updates are provided for the convenience of  the affiliate marketing industry and Affiliate Voice LLC members. Latest Updates

  • California – Another bill pending (ABX3 19 and SBX3 17) – high alert
  • Connecticut – Ongoing budget talks
  • Hawaii – vetoed by Governor due to technical issue in wording; similar legislation will be back next session
  • Illinois – early drafting of legislation in late 2008 and 2009; close watch for upcoming session
  • Maryland – did not pass committee; will be active again next session – high alert for next year
  • Minnesota – was part of Senate/House budget which was broad vetoed by Governor; high alert for next year
  • New York – New York Internet tax in effect since 2008 (June 2008); ability to rebut nexus
  • North Carolina – North Carolina Internet tax legislation part of pending budget
  • Pennsylvania – Ongoing budget talks
  • Rhode Island – Rhode Island Internet tax in effect (July 2009); strict interpretation
  • Tennessee – HB1947 and SB1741 stuck in committee this year; must be monitored closely

Please remember that any of the 45 states that have a sales and use tax can draft legislation to implement Internet sales tax or advertising tax; every state is examining doing so. Everyone in our industry should monitor legislation.
