As I reported earlier this morning at NYAffiliateVoice, North Carolina is just moments away from Internet sales tax, both Senate and Representatives accepted the commission report on the budget which includes the Internet sales tax or advertising tax. As of a few moments ago, the North Carolina Senate voted to pass the budget; they did so without debate. The House of Representatives is debating the budget, vote is probably moments away. At 4:30 pm on Wednesday, the House of Representatives voted to pass the budget. It goes on to the Governor.
As it stands, North Carolina’s Internet sales tax law will be similar to NY but as I explained in North Carolina Internet Sales Tax is Moments Away, interpretation of the law may be different. Some states will take a more stringent interpretation of the law, like Rhode Island. In Rhode Island there seems to be no ability to rebut the nexus if you have sales over the threshold.
